土著社區的處境因一宗強姦案再次受關注
系統性問題
"The system clearly failed this little girl," Queensland總理Anna Bligh說. 這宗強姦案的確並非個別事件.她確定了早前的一些傳媒報導, 早在2002年那名女孩已經在Aurukun第一次被性侵犯. 不過沒有人被檢控. 事件之後女孩送到一名監護人照顧, 不過2006年4月又被送回Aurukun土著保留地.不久之後便發生了該宗強姦案.

澳洲聯邦政府幾乎肯定會插手. 一份有爭議的控制計劃可能會延伸至Outback上所有的土著社區. 土著事務部長Jenny Macklin說她會當Queensland的顧問, 參照聯邦政府在Northern Territory針對兒童性虐待的行動.這急進的計劃在今年初推行.
在Northern Territory兒童性虐待日益猖獗. 原因除了疏忽照顧之外, 還有rivers of grog - 酒精問題. 這份凌駕地方法律的計劃包括加強警力, 查禁酒類和色情媒介, 還有將福利金直接付給學費和食物費.一份報告指這些措施對有同樣問題的偏遠地區應該也同樣有效. 不過, 在憲法上聯邦政府不一定有權力推行. 這次機會新政府一定不會錯過.

北Queensland的一個土著社區Aurukun有一名10歲的原住民女孩遭強姦. 9名被告全部罪名成立, 但全部不用坐牢. 這9名澳洲土著安然地步出法庭.判案的法官Sarah Bradley並不覺得這項判決不恰當. 她說她只不過是依照檢察官提的建議下判決, 再者, 她認為那女孩有可能是"同意跟那班流氓性交"的. 檢察官Steve Carter在庭上的說詞更妙, 他說其中6名未成年的被告只是玩了"孩子氣的實驗(childish experimentation)", 而另外3名被告則只是, uh, "頑皮(naughty)".
這不是甚麼殖民地歷史. 這是2007年判的案.

法官Sarah Bradley倒不是甚麼極右分子.如果那是一名白人女孩, 一位積極參與保護兒童運動的人假設, 而案件發生在白人社區, 那些被告不可能行出法院的.
Judge Bradley並不認為土著女性應該受次一等的保護. 畢竟, 她是現任Australian Association of Women Judges的主席, 主張"it's important for women to be seen in positions of authority and power."而且, 她對澳洲土著的權益相當關注. 1999年, 當她受任到higher court的時候, 土著領袖也很歡迎的. 因為她的參與推動一些program令澳洲土著不經澳洲監獄系統處置. 她認同在一些情況之下, 土著社區本身的和解或裁決會比較有較. "Sentencing indigenous offender is never easy," 她說.但要是她以為這種接近non-intervention可以維繫土著社區的司法自主的話, 恐怕是白費心機了. 這只會引發以暴易暴.
